The following is a listing of our Benefit Classifications. This
information will tell you exactly what your insurance covers. To

FACT -- In 2005, there were over
700 airline passenger fatalities worldwide.*
Common Carrier
This includes accidents that occur in aircraft, buses, taxis, ferries
and other common means of public transportation. This covers
accidental death while riding as a ticketed passenger, not as a
pilot or crewmember, on scheduled non-charter, certified airline
flights. Also covers accidental death while a fare-paying passenger
(not an operator or crewmember) on other common carriers licensed
primarily for passenger service.
FACT—Motor vehicle accidents claimed
45,800 lives in the United States in 2005.*
Auto and Pedestrian
This includes all accidents that occur when riding in, driving or
being struck by a private passenger vehicle. You will be covered
for accidental death while driving or riding in a private passenger
automobile or as a pedestrian when hit by a motor vehicle ordinarily
operated on public streets or highways.
FACT—Home accidents have accounted
for almost a third of the total number of fatal accidents.*
General Accidental Death
This includes falls, drowning, poisoning, electrocution and all other
types of fatal accidents not covered by the specific provisions of
the Common Carrier or Auto and Pedestrian accident coverage above or
excluded under What is Not Covered below.
PLUS—You will receive 24-hour-a-day
coverage, 365 days a year for all of the above Benefit Classifications—whether
you are at home, at work or at play!
What is Not Covered
This insurance covers accidental loss of life from injuries that are
a direct result of an accident or trauma occurring when insured under
the coverage while it is in force. Loss must be independent of sickness
and all other causes (all other causes not applicable in Vermont; in
California, Illinois, Montana and Nevada, sickness or bodily infirmity),
except sickness caused by the injury (and terrorism, in Maryland).
Benefits are payable only when a covered injury results in loss of
life within 365 days after the injury date (no time limit in
Pennsylvania).
This insurance does not cover loss resulting from: suicide, attempted
suicide or intentionally self-inflicted injury while sane or insane
(in Colorado and Missouri, while sane only; in New York and Pennsylvania,
suicide, attempted suicide or intentionally self-inflicted injury);
an act of declared or undeclared war (in Oklahoma, any war or act
of war, declared or undeclared, while serving in the military forces
or any attached auxiliary unit); injuries received while serving in
the armed forces (in New Jersey, we will refund all premiums on a
pro rata basis; in New York, loss sustained while serving in the
military or armed forces — the unearned portion of the premium will
be refunded with suspension of coverage for you, your spouse and
dependent children allowed for up to five years of continuous active
duty).
Benefits are also not payable for injuries received while (in Montana,
voluntarily; in New York, loss resulting from an insured person being)
under the influence of any controlled substance (narcotic, in Maryland),
except narcotics given on the advice of a physician (not applicable
in South Dakota, Vermont and Washington; in Connecticut, as defined
in Title II of the Comprehensive Drug Abuse Prevention and Control
Act of 1970, as now or hereafter amended, unless prescribed by a
physician). In addition, injuries resulting from an insured person
being (in Montana, voluntarily) intoxicated (as determined and defined
by the laws of the jurisdiction in which the loss or cause of loss
occurred; for the purposes of this exception, the laws governing the
operation of motor vehicles while intoxicated will apply) are not
covered (not applicable in Minnesota, Oklahoma, South Dakota, Vermont
and Washington; in New York and South Carolina, loss resulting from
an insured person’s being intoxicated; in South Carolina, for the
purposes of this exclusion, the laws governing the operation of
motor vehicles while intoxicated will apply).
No benefits are payable for loss resulting from an insured person’s
commission or attempted commission (attempted commission not applicable
in Georgia) of a felony or being engaged in an illegal (felonious in
Connecticut) occupation; loss resulting from a moving vehicle accident
occurring while an insured person is engaged in a contest of speed,
organized or not (not applicable in Iowa, New Jersey, New York,
Vermont, Virginia and Washington; in Minnesota, loss resulting from
a moving vehicle accident occurring while an insured person is engaged
in an organized contest of speed); loss resulting directly or indirectly
(in California, Illinois, Montana and Nevada, directly) from disease
or bodily infirmity or that occurs (in Maryland and New York, injuries
that occur) while this coverage is not in force.
Renewal and Premium Guarantees
You will never be singled out for a rate increase. Your rates cannot
be increased due to illness or injuries to a person insured. Rates
can only be increased if they are changed for everyone of the same
classification insured under this coverage in your state. Your
coverage will never be cancelled as long as your premiums are paid
on time. If you wish, you can cancel your coverage at any time. At
age 80, this coverage terminates. Under the Family Plan, coverage
ends for your insured spouse and dependent children when you reach
age 80, or on the date of your death, if before that. Your spouse,
if under age 80, can continue coverage by submitting a request to
become the primary insured (request not required in Pennsylvania)
and paying the premium within 60 days of the policy renewal date
following the date your coverage ended (in Virginia, your spouse
automatically becomes the primary insured upon your death). A
person may be insured under only one insurance plan of this form
at any one time.
Risk-free Right to Review Coverage
You have a risk-free right to review this coverage for a full 60 days
(30 days in New York). If you change your mind for any reason,
simply return your insurance plan within that period of time and
Mutual of Omaha will issue you a refund check for the full amount
of your payment.
How Benefits Are Paid
Benefits payable in the event of your death are paid to your beneficiary
or to your estate if no beneficiary is named or living. Family Plan
spouse or dependent child benefits are paid to you, if living,
otherwise to your estate.
Eligibility of Coverage
Adults are eligible for coverage if ages 18 to 70 (18 through 64 in
Minnesota). The Family Plan insures you, your spouse age 18 to 70,
(18 through 64 in Minnesota) and all unmarried dependent children
under the age of 21 (19 in New Jersey, 22 in North Dakota,
24 in Indiana, 25 in Texas, 26 in Utah), or under age 25 (24 in
Louisiana, 26 in North Dakota and Utah, no age limit in Texas) if
a full-time student at an accredited educational institution.
Those insured may have no other Accidental Death Insurance with
Mutual of Omaha.
This policy provides ACCIDENT insurance only. It does NOT provide
basic hospital, basic medical or major medical insurance as defined
by the New York State Insurance Department. The expected benefit
ratio for this policy is 50%. This ratio is the portion of future
premiums which the company expects to return as benefits, when
averaged over all people with this policy. IMPORTANT NOTICE --
